Live Nation President Joe Berchtold will reportedly tell members of Congress that “industrial scalpers” and a “cyberattack” caused the Taylor Swift ticket sales meltdown last year, in testimony before a Senate judiciary subcommittee on Tuesday–a strategy that could distract from the antitrust issues lawmakers plan to target.

Lawmakers are expected to focus on Ticketmaster’s outsize power in the industry and whether its consolidation with Live Nation in 2010 stifled competition and harmed consumers, subcommittee member Sen. Amy Klobuchar (D-Minn.) said in a statement that also noted Ticketmaster’s “dominant market position means the company faces inadequate pressure to innovate and improve.”

Berchtold, meanwhile, plans to tell the committee it was hit by a cyberattack in November that caused an unprecedented “amount of bot traffic,” according to multiple reports detailing his testimony, which suggests “industrial scalpers” may have been responsible.
